These Terms of Use (Terms) govern your use of our website located at https://www.asianfusionmealprep.com (Site) and form a binding contractual agreement between you (Customer/Consumer/User), the user of the Site and us, Asian Fusion Meal Prep.

 

The Site is owned and operated by Asian Fusion Meal Prep (We/Us).

By using the Site, you acknowledge and agree that you have had sufficient chance to read and understand the Terms and you agree to be bound by them. If you do not agree to the Terms, please do not use the Site.

 

1)      License to use Site

a)      We grant you a non-exclusive, worldwide, non-transferable license to use the Site in accordance with these Terms.

b)      You may access and use the Site (including any incidental copying that occurs as part of that use) in the normal manner and may also print one copy of any page within the Site for your own personal, non-commercial use.

c)      You must not add any content to the Site:

i)      unless you hold all necessary rights, licenses and consents to do so;

ii)     that would cause you or us to breach any law, regulation, rule, code or other legal obligation;

iii)    that is or could reasonably be considered to be obscene, inappropriate, defamatory, disparaging, indecent, seditious, offensive, pornographic, threatening, abusive, liable to incite racial hatred, discriminatory, blasphemous, in breach of confidence or in breach of privacy;

iv)     that would bring us, or the Site, into disrepute; or

v)      that infringes the intellectual property or other rights of any person.

d)      The Site contains links to other websites as well as content added by people other than us. We do not endorse, sponsor or approve any such user generated content or any content available on any linked website.

e)      You acknowledge and agree that:

i)      we retain complete editorial control over the Site and may alter, amend or cease the operation of the Site at any time in our sole discretion without prior notice; and

ii)     the Site will not operate on a continuous basis, and may be unavailable from time to time (including for maintenance purposes) without prior notice.

 

2)      Intellectual property rights

a)      Nothing in these Terms constitutes a transfer of any intellectual property rights. You acknowledge and agree that, as between you and us, we own all intellectual property rights in the Site.

b)      By posting or adding any content onto the Site, you grant us a perpetual, non-exclusive, royalty-free, irrevocable, worldwide and transferable right and license to use that content in any way (including, without limitation, by reproducing, changing, and communicating the content to the public) and permit us to authorize any other person to do the same thing.

c)      You consent to any act or omission which would otherwise constitute an infringement of your moral rights, and if you add any content in which any third party has moral rights, you must also ensure that the third party also consents in the same manner.

d)      The license in paragraph (c) will survive any termination of these Terms.

e)      You represent and warrant to us that you have all necessary rights to grant the licenses and consents set out in paragraphs (b) and (c).

 

3)      Warranties

You represent and warrant to us that:

a)      you have the legal capacity to enter these Terms; and

b)      you have complied with clause 1(c).

 

4)      Liability

a)      To the full extent permitted by law, we exclude all liability in respect of loss of data, interruption of business or any consequential or incidental damages.

b)      To the full extent permitted by law, we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these Terms.

c)      These Terms are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions, guarantees or obligations. If such legislation applies, to the extent possible, we limit our liability in respect of any claim to, at our option:

i)      in the case of goods:

(1)     the replacement of the goods or the supply of equivalent goods;

(2)     the repair of the goods;

(3)     the payment of the cost of replacing the goods or of acquiring equivalent goods; or

(4)     the payment of having the goods repaired; and

ii)     in the case of services:

(1)     the supply of the services again; or

(2)     the payment of the cost of having the services supplied again.

 

5)      Termination

a)      These Terms terminate automatically if, for any reason, we cease to operate the Site.

b)      We may otherwise terminate these Terms immediately, on notice to you, if you have breached these Terms in any way.

 

6)      General

a)      You must not assign, sublicense or otherwise deal in any other way with any of your rights under these Terms.

b)      If a provision of these Terms is invalid or unenforceable, it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.

c)      Each party must at its own expense do everything reasonably necessary to give full effect to this Agreement and the events contemplated by it.

d)      These terms are governed by the laws of Queensland and each party submits to the jurisdiction of the courts of Queensland.

 

7)      Order Cancellations

We use fresh ingredients weekly and cook our meals fresh to order every week. Due to this reason to cancel your order you must notify us within 24 hours of placing the order. Unfortunately, any cancellation requests made after this time cannot be honored as your meals will already be prepared. Therefore, you will be charged the full amount of the order. 8)       Payment

a)       Any transactions or purchases offline can be made via bank transfer. BSB and account number details will be visible upon the checkout process.

b)       Any transactions or purchases online can be made via MasterCard, Visa, Paypal only. All transactions are processed via our partner payment service Paypal.

c)        In store transactions may be made by cash, direct debit, Visa or MasterCard through our shopfront using our EFTPOS merchant facility.

d)        All payments have to be made before your purchase can be delivered. When paying by card, if you have insufficient funds in your account or the card declines - the purchase will not go through. For direct transfers, your meals will only be delivered once the transfer has been completed.

e)        If you cannot pay using the methods above, please contact us on 0410 237 188 and we can try organize a solution for you.

9)       Security

All credit card payments are processed securely through a PCI compliant Payment Gateway (Paypal Payments) and payments are made directly through 256 bit SSL Encryption software to ensure your personal details are kept safe. Asian Fusion Meal Prep does not store any credit card information on our servers. We may also change or add additional payment gateways to our website in the future. We take reasonable steps to protect your personal information. However, we are not liable for any unauthorized access to this information.

10)      Acceptance of Order

We reserve the right to accept or reject your order for any reason, such as the unavailability of any product or service, an error in the price of the product or service or an error in your order.

11)      Order Cancellations By Us

We reserve the right not to provide goods or services, remove or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.

12)      Discounts & Promotions

Discounts or promotion codes are non-transferable and cannot be transferred or refunded for cash. Furthermore, Asian Fusion Meal Prep reserves the right to cancel any promotion or discount without prior notice. Only a single discount or promotion code per order and cannot be used in conjunction with any other discounts or promotions.

Disclaimer

Prior to consuming any products from Asian Fusion Meal Prep it is important to note that we make a variety of meals in our kitchen. We cannot guarantee any products sold on our website are completely free from any allergen such as wheat, soy, diary, egg, nuts, sesame, peanuts, gluten, tree nuts, crustacean and fish.

Care is taken to ensure the exact amounts are included in each meal. However, please allow for a 5% discrepancy in the actual weight of the meals.

​

If you have a life threatening allergy it is advisable you do not purchase meals from Asian Fusion Meal Prep as we cannot guarantee the complete absence of these ingredients from our products.

Return & Refund Policy

The Return & Refunds Policy covers refused, returned and incorrect orders due to system error, customer error and driver inability to safely and correctly deliver an order.

Should a customer or any person located at the delivery address (home or business) refuse the delivery or not be present to accept the delivery, the goods will be returned to the store. Refused or returned deliveries will be kept at our kitchen for four days only and the Customer must make arrangements with us to pick up their order. Customer orders not picked up within four days of return will be disposed of as per Food Health & Safety Policies. Customers bare all costs associated with the refusal and return of any order to our kitchen. Please note the delivery fee is non-refundable. If you request another delivery on the next available delivery day in your area, an additional delivery fee will apply.

Asian Fusion Meal Prep will refund payment in the event that there is a confirmed error made by us and you have been incorrectly charged.

You have a wide variety of meals to choose from so please order your plan carefully. After placing your order please review your meal prep option and sauce selection and contact us immediately if a mistake has been made. We do not give refunds for change of mind or incorrect meal selection by the customer once the meals have been prepared. We will provide a refund or exchange in the instance your meal order is incorrect and/or different to what you purchased online (error made by us). Please contact us immediately on 0410 237 188 if this occurs or email directly at asianfusionmealprep@outlook.com.

This refund policy does not apply to goods which have been consumed after delivery, or if any attempt has been made to alter the product or if they have been dropped or opened. If you do not notify us of any delivery issues within 24 hours of delivery, we may not be able to give you an appropriate refund where possible. Please allow 2-3 business days for refunded funds to appear in your account. Failure to adhere to the terms and conditions of Asian Fusion Meal Prep will prohibit any refunds or credits being issued to the Customer. Asian Fusion Meal Prep will not be held liable to any financial or physical damages of any kind.

When necessary, we will disclose personal information to third parties to aid in our business processes such as delivery by contracted couriers. We do not by any means share any information with third parties for unknown or unrelated uses.

 

6)      Disclosure of your personal information overseas

We take reasonable steps to protect your personal information. However, we are not liable for any unauthorized access to this information.

 

8)      Access to your personal information

You can access and update your personal information by submitting a written request via direct email at asianfusionmealprep@outlook.com. We may charge a reasonable administration fee for this access.

 

9)      Complaints about privacy

We take complaints very seriously and will endeavor to respond within 48 business hours of receiving written notice of your complaint.

Please be aware that we may change this Privacy Policy in the future. The revised versions will be uploaded onto our website, so please check back from time to time.

When you visit our website

When you come on to our website we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyze how people use our site, such that we can improve our service.

Delivery Policy

Delivery Service

  • We deliver to areas on the Gold Coast, Tweed Head, Brisbane and Ipswich. A flat rate is charged for each delivery based on your suburb and city. Additional orders to the same address on the same day is charged at $8 per additional order. Please click here for delivery availability information.

 

  • In the event that a customer or any person located at the delivery refuse the delivery, the goods will be returned to the store. Refused or returned deliveries will be kept at our kitchen for four days only and the Customer must make arrangements with us to pick up their order. Customer orders not picked up within four days of return will be disposed of as per Food Health & Safety Policies. Customers bare all costs associated with the refusal and return of any order to our kitchen.

 

  • Please note the delivery fee is non-refundable. If you request another delivery on the next available delivery day in your area, an additional delivery fee will apply. If the next delivery day exceeds 4 days, your meals will be delivered frozen.

 

  • It is your obligation to enter the correct delivery address details at time of ordering. If you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.

 

  • We will provide you with an estimated date of delivery of your meals and will make every effort to deliver by this date. If your delivery date falls on a Public Holiday your meals will be delivered on the next business day.

 

  • If you live in a secured apartment complex, please ensure you are home to receive your delivery. If no one is available to collect your delivery, please arrange a suitable time with our staff prior to the delivery date. If our driver is unable to access the apartment you will have to organize a different delivery date for an extra charge.

 

  • It is the responsibility of the customer to inform Asian Fusion Meal Prep by calling us on 0410 237 188 if an order does not arrive. Once we learn an order has not arrived on the due date, we will inquire into it and ensure delivery occurs as soon as possible. We will not be held liable for any loss or damage resulting from late or failed delivery.

 

Delivery Days and Times 

You, the customer, hereby agree and acknowledge that the delivery day and time will depend on which suburb and postcode you nominate your delivery address to be. Delivery day is Sunday. Delivery time blocks are 10am – 7pm for each delivery day. Asian Fusion Meal Prep and/or contracted couriers cannot provide a specific time of delivery, however an approximate time of delivery can be provided by sending a SMS to 0410 237 188 on the morning of delivery day.  There may be times where circumstances arise that may delay or reschedule your delivery order for the next delivery day and not on your selected delivery day.

 

Ordering Cut-off Times

You, the customer, hereby agree and acknowledge that for Sunday delivery (subject to suburb) orders must be placed by Thursday 11:30pm.

Delivery Payment

All payments have to be made before your purchase can be delivered. When paying by credit card, if you have insufficient funds in your account or the card declines - the purchase will not go through and delivery will not go ahead. For direct transfers, your meals will only be delivered once the transfer has been completed.

Delivery Acceptance

Meals are delivered in a health certified polystyrene box, packed with ice packs to ensure meals are always at the correct temperature. In the event that no one is present at the nominated delivery address the courier will leave your order in a shaded area. Orders can be left in a shaded area for up to 5 hours. You can specify a secure area where you would like your delivery to be left when you place your order.

Meals should be stored away in the refrigerator and/or freezer no later than 7pm on delivery day.

Asian Fusion Meal Prep accepts no liability, losses or responsibility for the meals to customers once delivery has been completed.

Heating Instructions | Meal Storage & Consumption

Reheating and Microwave Instructions

​

Refrigerated meals: Microwave 3-4 minutes on HIGH. Stir through and reheat for longer if required.

​

Frozen meals: Allow 8 hours in the refrigerator to defrost then microwave 5 minutes on HIGH. Stir through and reheat for longer if required.

​

- Meals must be consumed within 48 hours once thawed.

​

- Meal must be consumed within the Use By Date if refrigerated or consumed within 3 months from the Use By Date if frozen. Please refer to the Use By Date located on the top of the container lid of the meal.

 

Limitation of Liability: Food Storage

Asian Fusion Meal Prep accepts no liability, losses or responsibility to customers and/or users of this website who do not correctly refrigerate, freeze or otherwise store their meals in a manner which is fit for safe human consumption. The customer is solely responsible for proper storage and safekeeping of their meals. Asian Fusion Meal Prep is not responsible for any food poisoning that may occur due to improper food handling and storage.

Upon delivery of your meals, meals should be placed in the refrigeration or freezer by 7pm.

Store meals below 4°C in the refrigerator or store at or below -18°C in the freezer.

 

Limitation of Liability: Reheating of Meals

Asian Fusion Meal Prep accepts no liability, losses or responsibility to customers and/or users of this website who do not correctly reheat their meals. Asian Fusion Meal Prep cannot be held responsible for variations in cooking times among customers using different makes and models of microwave ovens, or traditional ovens.
